Growmoneyology Terms of Service

This Terms of Use Agreement (hereinafter referred to as the "Agreement") explains the contractual agreement between Growmoneyology, ("Growmoneyology", "us", "our", "we") and User ("User", "you", "your"). This Agreement is made to be effective as of the date accepted by User following the completion of registering for Growmoneyology. The Growmoneyology website ("Site") contains content that is provided as a service to users who agree to abide by the following acceptable conduct terms. If you disagree with any of the terms of this agreement, you may not use Growmoneyology or services. By using the services provided by Growmoneyology, you and Growmoneyology are subject to any additional guidelines applicable to such services. All such guidelines are hereby incorporated by reference into the Terms of Use Agreement. Growmoneyology reserves the right to modify or discontinue, temporarily or permanently, the Site, any site features, benefits, rules or conditions, all without notice, even though such changes may affect the way you use the site. You agree that the Site will not be liable to you or any third-party for any modification or discontinuance of the Site.

We reserve the right to change, modify or otherwise alter the Terms of User Agreement at any time. Such modifications shall become effective immediately upon the posting thereof. We recommend that you review this agreement on a regular basis stay informed at all times.

Without limitation, the User agrees to refrain from any of of the following actions while interacting with the Site:

(A) Harassing, threatening, embarrassing or causing distress or discomfort upon another individual or entity or impersonating any other person or entity or otherwise restricting or inhibiting any other person from using or enjoying the Site; (B) Transmitting any information, data, text, files, links, software, chats, communication or other materials that is unlawful, false, misleading, harmful, threatening, abusive, invasive of another's privacy, harassing, defamatory, vulgar, obscene, hateful or racially or otherwise objectionable, including without limitation material of any kind or nature that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, provincial, national, or international law or regulation, or encourage the use of controlled substances; C) Posting advertising or solicitation in categories that is not appropriate, or posting the same item or service in more than one category or more than once every 3 days, or posting the same ad in multiple cities on the Site; (D) Posting adult content or explicit adult material unless such material is specifically permitted in designated adult categories and permitted under applicable law; (E) Posting any ad for products or services, use or sale of which is prohibited by any law or regulation; (F) Sending mail, e-mail, voice messages or faxes for solicitation of any other product, service to a user of the Site unless the user has granted permission in their ad or otherwise allowing contact for solicitation; (G) Interfering with or infringing the patents, copyrights, trademarks, service marks, logos, confidential information or intellectual property rights of others; (H) Using any automated device, spider, software or routine which can interfere with the proper working of the Site; (I) Taking any action creating a disproportionately large usage load on the Site. Exceptions include search engines such as Google.com, Yahoo!, and the like; (J) Sending messages or engaging in disruptive activities online, including excessive use of scripts, sound waves, scrolling, or use of viruses, bots, worms, time bombs, trojan horses or any other destructive element; (K) Attempting or having unauthorized access to non-public areas of the Site. In addition, if you have a password to a non-public area of the Site, you may not disclose to, or share your password, with any third parties and/or use your password for unauthorized purposes; (L) Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up all or any part of the Site; modifying any meta data, copying or duplicating in any manner any of the content; framing of or linking to any of the Site, its content or information available from the Site without the express written consent of agents of the Site; (M) Discriminating on the grounds of race, religion, national origin, gender, disability, age, marital status, sexual orientation, or refers to such matters in any manner prohibited by law; (N) Posting any ads or messages which violates any law or regulation; and/or Using the Site to engage in or assist another individual or entity to engage in fraudulent, abusive, manipulative or illegal activity. (O) You may not use any device, software or routine, including but not limited to any viruses, trojan horses, worms, time bombs, cancelbots or denial-of-service attacks, intended to damage or interfere with the proper working of the Site or any transaction being conducted on the Site. ( P) You may not take any action that imposes a large load on the infrastructure of the Site, including but not limited to spam or other such unsolicited e-mailing techniques.

You agree to comply with all applicable laws, statutes, regulations, and ordinances concerning your use of the Site.

USE OF THE SITE, CONDUCT & USER IDENTITY
(A) You hereby warrant and represent that you are at least sixteen (16) years of age or at least eighteen (18) years of age for your specified city and have the legal capacity to enter into the agreements of Growmoneyology. If you do not fulfill the minimum age requirements for the required sections of your local social network, or if you do not agree to each of the terms of this agreement, or if accessing this site would cause you to violate any law whatsoever, we ask that you refrain from using the site immediately. Any misrepresentation of your age to gain access to any section of your local social network is a violation of the law. (B) You hereby warrant and represent that you understand that rules of the specific sections of the local social network you are accessing. You represent that, based on your understanding of these rules, by requesting and receiving any of the adult material on Growmoneyology, you will not be violating any of these consequences related to your requesting, receiving or possessing materials contained on the Site. You agree that accessing the sections closed off for users eighteen (18) years of age and older, that your access is strictly for entertainment purposes and not to violate any laws whatsoever. C) You hereby agree that there are certain sections of Growmoneyology designed for the private, non-commercial enjoyment of Users over eighteen (18) years of age. Any other use is prohibited. You grant the Site (and our affiliates) the irrevocable right to use and/or edit your ads and messages, without review or approval by you, for any purpose whatsoever, including, without limitation, reproduction, disclosure, transmission, publication, broadcast, posting, and advertising in any media in perpetuity without notice or compensation to you. We are in compliance with the requirement of COPPA (Children's Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. The site, products and services are all directed to people who are at least eighteen (18) years of age. Nevada Small Biz is not responsible for representations or warranties with respect to any user or user conduct. Each user is solely responsible for their interaction with or reliance on any user or user conduct. We recommend all users to do their due diligence and research before performing actions on the Site.

TERMINATION OF ACCESS
The Site has the right to terminate your access for any reason if we believe you have violated the terms of service in any manner. Unless otherwise agreed to in writing between the parties, either party may terminate the service at any time upon notice to the other party. Any termination will be subject to the terms of this Agreement.

THIRD PARTY LINKS
Occasionally, at our discretion, we may include or offer third party products or services on the Site. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. We seek to protect the integrity of the Site at all times.

LINKS
Growmoneyology  is not responsible for the content from links that may be linked to or from the Site. Any websites linked to or from the Site are intended to be of convenience to the user, and are accessed at your own risk.

PRIVACY
Your use of the Site and the services provided therein and thereby is governed by the terms of this Agreement and the terms of Growmoneyology's Privacy Policy.

DISCLAIMERS
THE SERVICES PROVIDED HEREUNDER ARE PROVIDED "AS IS", WHERE IS, AND WITHOUT ANY WARRANTIES OR CONDITIONS (EXPRESSED OR IMPLIED, ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OR TRADE). WE MAKE NO REPRESENTATIONS OR WARRANTIES, OF ANY KIND, EITHER EXPRESS OR IMPLIED, AS TO THE QUALITY, IDENTITY OR RELIABILITY OF ANY USER OR THIRD PARTY, OR AS TO THE ACCURACY OF THE POSTINGS MADE ON THE WEB SITE BY ANY USER. YOUR ACCESS TO GROWMONEYOLOGY AND YOUR ACCESS TO THE GROWMONEYOLOGY SITE IS AT YOUR SOLE RISK.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GROWMONEYOLOGY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. ANY MATERIAL OR INFORMATION DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF AND ACCESS TO GROWMONEYOLOGY IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU HEREBY ACKNOWLEDGE THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR NETWORK AND ANY LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF OR ACCESS OF ANY SUCH MATERIAL.

LIMITATION OF LIABILITY
Growmoneyology is not liable to any user for any indirect, punitive damages pursuant to this Agreement, including but not limited to, loss of profits, loss of or business opportunities. In the event that you have a dispute with any users, you are agreeing to release us from any claims, demands and damages of every type. By using the site you waive the provisions of any state law limiting or prohibiting a general release.
Except in jurisdictions where such provisions are restricted, in no event will Growmoneyology be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the website or the service, even if Growmoneyology has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Nevada Small Biz liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Growmoneyology for the service during the term of membership.

INDEMNITY
You agree to indemnify and hold harmless the Indemnified Parties from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, the violation of these Terms by you, or the infringement by you, or other users of the Site using your computer, of any intellectual property or other right of any person or entity. The Site reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.
